TERMS & CONDITIONS

The New Mexico Gang Investigators Association, herein after referred to as NMGIA, offers "Members Only" online resources for active members via secure login credentials. Resources include; an information sharing platform, members directory, members location map and event registration platform.

You agree:

• that you will not use the NMGIA platform for any illegal purpose or in any way that interrupts, damages or impairs the services provided;
• that you will not access or attempt to access the accounts of other users of the NMGIA platform;
• that you will not impersonate any person, or misrepresent your identity or affiliation with any person;
• not to post or transmit through the NMGIA  platform any content which is or could reasonably be viewed as:
• hate speech, obscene, harassing, threatening, pornographic, abusive or defamatory to an individual or group of individuals on the basis of religious belief, race, gender, age, disability or otherwise;
• inciting violence, or containing nudity or graphic or gratuitous violence;
• an unauthorized commercial communication of any kind (including, without limitation, spam);
• fraudulent, inaccurate or misleading, or is otherwise objectionable content of any kind;
• infringing or violating someone else’s rights or otherwise violates the law;
• identifying any person without their consent or disclosing anyone else’s personal contact details or invading their privacy, or
• containing software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of the NMGIA platform, or any computer software or hardware or telecommunications equipment.
• that any content you post or upload to the NMGIA platform or otherwise make available via the NMGIA platform is owned by you.
• to refrain from doing anything which is defamatory, offensive, damaging or which we believe might damage the reputation of the New Mexico Gang Investigators Association, a provider of services accessed through the NMGIA platform or the Publisher;
• not to copy NMGIA platform content except where such copying is incidental to the normal non-commercial use, or where it is necessary for the purpose of back-up or operational security;
• not to make alterations to, or modifications of, the whole or any part of the NMGIA platform or any content, or permit the NMGIA platform or any part of it to be combined with, or become incorporated in, any other programs;
• not to infringe our intellectual property or the Publisher’s or our other licensors’ intellectual property in relation to your use of the NMGIA platform;
• that you are solely responsible for your interactions with other users and users through the NMGIA platform;
• that you will not collect other users’ and users' content or information, or otherwise access the NMGIA platform, using automated means (such as harvesting bots, robots, spiders or scraping techniques) or otherwise, without our prior written permission;
• that any content you upload or post to the NMGIA platform (with the exception of private messages, which are confidential in nature) will be considered non-confidential and non-proprietary and that such content may be viewable by any users of the NMGIA platform. You will own your content, but you hereby grant us, our licensee’s and any third parties and other users of the NMGIA platform (each as we determine) a perpetual, irrevocable, royalty-free, transferrable, sub-licensable, worldwide license to use, store and copy that content and to distribute it and make it available to third parties via any and all media, including, without limitation, the right for us to upload and make available and to authorize third parties to upload and make available such content on third party sites and services, including social media applications and channels such as Facebook, Twitter, Pinterest, YouTube, Instagram and on the Publisher’s owned websites;
• that you waive any moral rights or equivalent rights in any jurisdiction in relation to any content that you upload or post to the NMGIA platform and that we can use such content without referencing you as the author of such work and that we can adapt and amend such content in our sole discretion;
• to compensate and defend us fully against any claims or legal proceedings brought against us by any person as a result of your breach of these Terms;
• to keep your password secure at all times and not to disclose your password to any other person;
• not to allow any other person to use or access your account;
• to comply with all laws applicable to you.
• to not breach our Intellectual property rights in the course materials, online Courses and the speeches made by trainers at the taught courses of the New Mexico Gang Investigators Association or its licensors, whether adapted, written for or customized for the client or not.
• that you are not authorized to:
• copy, modify, reproduce, re-publish, sub-licence, sell, upload, broadcast, post, transmit or distribute any of the Course Materials without prior written permission;
• record on video or audio tape, relay by videophone or other means online courses or taught course given
• use the Course Materials in the provision of any other course or training whether given by us or any third party trainer;
• remove any copyright or other notice of NMGIA on course materials;
• modify, adapt, merge, translate, disassemble, de-compile, reverse engineer (save to the extent permitted by law) any software forming part of online courses.
• to protect your username and password by:

• not sharing your username or password with anyone.

• keeping written or stored username and password secured at all times.
• while unsecured, maintain positive control of your written or stored usernames and passwords.

• ensuring you maintain positive control of the device of which you are accessing our services while logged on.
• ensuring you lock your screen if you step away from your device while logged in.
• ensuring you logout when you are finished with your session on our online resources.
• using a strong password combination.
• notifying us immediately if your account becomes compromised,.
• resetting your password immediately if you become aware of your password being compromised or accessible to anyone other than yourself.

• to set up your account fully as outlined below in our Privacy Policy and membership application.

Violation of these Terms and Conditions will result in immediate removal from the platform and disciplinary action up to and including revocation of membership. To appeal disciplinary action refer to the NMGIA bylaws, Article X Discipline, Section 3 Due Process.
